With particular expertise in providing strategic advice to financial institutions in the context of borrower default and advising companies facing financial difficulties, the team has a broad and lengthy experience in the areas outlined above including some recent assignments as follows:

  • Advising the special liquidators of Irish Bank Resolution Corporation Limited including acting for the joint special liquidators in the sale of the various loan portfolios, including in particular the Evergreen portfolio comprising loans in the region of €458 million.
  • Advising the joint special liquidators in the context of the ongoing legacy litigation concerning former directors of IBRC and Irish Nationwide Building Society.
  • Acting for the National Asset Management Agency in the context of the Sean Dunne bankruptcy.
  • Advising Grant Thornton, as receivers appointed over the various Sean Dunne related companies and other assets held by him.
  • Acting for Grant Thornton in the receivership of a shareholding in the Blackrock Clinic and representing the receiver in a borrower challenge to the appointment of the receiver and sale of the asset.
  • Advising KPMG, the receivers of the TF Hotel and Theatre Royal in Castlebar where a borrower challenged the appointment of receivers and successfully defeated.
  • Acting for the receivers, PwC of the Fota Island Resort.
  • Advised Kiawah Developments in the context of its investment in the Doonbeg Golf Resort.
  • Acting for NAMA in a number of large scale cases, including successfully defending plenary proceedings issued by a NAMA debtor against NAMA and advising NAMA in relation to comprehensive settlements reached.
  • Acted for William Carr & Sons, a seafood processing company in the context of the provision of insolvency advice to its directors and the appointment of a receiver.
  • Advising Bank of Scotland, AIB, Bank of Ireland and Ulster Bank in a broad range of enforcement actions including related litigation and large scale receiverships.
