Planning

Ronan Daly Jermyn advises semi-state body, developer, industry and university clients, in relation to planning law issues. Such advices range from assisting them in achieving compliance with planning obligations to assisting them in all stages of large scale planning applications. Additionally we advise in relation to both the prosecution and defence of planning enforcement actions (both civil and criminal) through the Courts. In particular we advise on:-

  • Acting for Bon Secours Group in relation to planning issues pertaining to large scale redevelopment at their Cork campus including a Judicial Review taken by an adjoining landowner.
  • Acting for Cork Airport / DAA in relation to three separate Planning Injunctions taken against unauthorised car parks pursuant to s.160 of the Planning Acts.
  • Acted for the proposed developer of a wind farm in relation to An Bord Pleanala oral hearing pursuant to the Planning & Development (Strategic Infrastructure) Act, 2006 together with the subsequent oral hearing.
  • Advising Receivers on various planning issues including Part V compliance.
  • Advised The Diocese of Cloyne in relation to an Bord Pleanála Oral Hearing pertaining to the controversial proposed re-ordering of Cobh Cathedral.
  • Act for The Grosvenor Group & O’Callaghan Properties in relation to land holdings in West Dublin (including the Liffey Valley Shopping Centre) including all planning applications to date at Liffey Valley, rezoning issues, to date two separate An Bord Pleanála Oral Hearings and a related 5 day High Court Judicial Review challenge.
  • Acted for the developer in matters relating to a proposed rival €100m town centre project, including a successful Judicial Review taken against Carlow Town Council relating to its decision to renew that rival’s planning permission for 5 years without satisfying itself of the relevant Planning & Development Regulations, 2001 requirements.
  • Have acted for various manufacturers and quarries in defence of s.160 planning injunctions and/or district court prosecutions taken by local authorities.
