Over the last number of years there has been an increased focus on tougher regulation and greater powers of enforcement for regulators. As result the infamous “Dawn Raid” or search and seizure investigation has become part and parcel of the standard investigation toolkit for regulatory bodies. Unannounced investigations not only disrupt businesses and harm corporate reputations but may also result in criminal and civil sanctions. For corporate counsel, these investigations present unique challenges and responsibilities as the first (legal) responders to such investigations.

This briefing will examine the role of corporate counsel in responding to investigations and discuss some key legal issues that can arise, including the impact of the recent Supreme Court decision in CRH, plc, Irish Cement Limited & Seamus Lynch v the Competition and Consumer Protection Commission.
