Health & Safety

Health and safety in the workplace has become greatly regulated in recent years. Ensuring compliance with the increasing amount of legislation is a growing concern for businesses at all levels as non-compliance can have serious consequences for an employer. Inspections by the HSA can lead to them issuing enforcement notices to employers and in some cases to a workplace being closed down by order of the Court. We regularly provide our clients with advice on:

  • Claims for injuries made against employers for breaching legislation
  • Compliance procedures, including safety statements and risk/hazard analysis
  • Defence of prosecutions under the legislation
  • Due diligence training
  • Environmental/health and safety warranties
  • Enforcement actions
  • Food safety
  • HSA inspections and decisions
  • Interpretation of EU and Irish legislation
  • Obligations in construction projects relating to designers, contractors and developers
  • Workplace incidents

  • Ronan Daly Jermyn advises Cork County Council on health and safety matters such as the role of Project Supervisor Construction Stage under the Safety Health and Welfare Construction Regulations, the general obligations under the Safety Health and Welfare Act 2005 and the General Application Regulation. We also provide workshops on health and safety legal obligations.
  • Ronan Daly Jermyn acted for a pharmaceutical client in the defence of a prosecution taken by the DPP in the Circuit Criminal Court arising from a fatal accident (explosion). The prosecution was taken against a number of parties. In 2012 a fine of €300,000 was imposed on the Company and the actions taken against individual officers of the company were dropped.
  • We provide specific health and safety training to various employers, including local authorities, insurer clients and hospital medical staff.

  • According to a source, Finola McCarthy “susses out the issues and puts usable options in front of us." Another adds: "She has excellent knowledge of current industry practices. McCarthy handles the full range of construction mandates and has expertise in health and safety, planning and environmental law. ”  – Chambers Europe
