Product Liability

Ronan Daly Jermyn’s cross-disciplinary Product Liability team regularly advise Irish and international companies, consumers, manufacturers and insurers on a variety of contentious and non-contentious issues in the sector. Our practitioners, in advising on regulatory compliance and media relations in the event of crisis management, offer particular expertise in the following areas:

  • Crisis management
  • Intellectual property disputes
  • Liability to commercial contracts
  • Product liability litigation and dispute resolution
  • Product recall
  • Product safety law
  • Regulatory and compliance issues
  • Risk management

  • We successfully acted for Cork Plastics Manufacturing in Irish Litigation regarding discolouration of plastic, which mirrored extensive UK and French litigation on the same subject. This was one of the largest product liability claims cases in the history of State and the myriad pre trial issues that arose spawned at least three judgements on various aspects of practice and procedure.
  • We acted for a leisure craft manufacturer pursuing very substantial losses and damages against the manufacturer and supplier of defective resin used in the manufacture of vessels’ hulls. The matter was ultimately settled before trial after very extensive discovery – see Cara Marine Limited –v- Cray Valley Limited and GRP Material Supplies Limited.
  • We have recently been involved in product liability claims before the Irish High Court in a number of areas including discolouration of PVC, dairy product packaging, carrier chains for conveyor belts, wheelchairs, industrial tape and water heater cylinders.
  • One of our partners, Ronan Geary, is the author of the Irish Chapter in the annual publication “Product Recall in Worldwide Jurisdictions”.
